01 — Introduction

Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client", "Traveller", or "you") and Ceylon Horizons (Pvt) Ltd ("Ceylon Horizons", "we", "our", or "us"), a company incorporated in Sri Lanka.

By making a booking, accessing our website, or using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you are booking on behalf of others, you confirm that you have authority to do so and that all persons in your group agree to these Terms.

These Terms apply to all tour packages, day trips, hotel accommodations, transfers, and ancillary travel services offered by Ceylon Horizons. Nothing in these Terms affects your statutory rights under the laws of Sri Lanka.

02 — Bookings

Bookings & Reservations

A booking is confirmed when you receive a written confirmation from Ceylon Horizons and a deposit has been received. The following conditions apply:

  • All bookings must be made by a person aged 18 or over who accepts responsibility for the entire travelling party.
  • A non-refundable deposit of 25% of the total tour cost is required at the time of booking to confirm your reservation.
  • The remaining balance must be settled no later than 30 days prior to departure. Failure to pay the balance may result in cancellation of the booking.
  • For bookings made within 30 days of departure, full payment is required at the time of booking.
  • Booking confirmation is subject to availability and Ceylon Horizons reserves the right to decline any booking at its discretion.

Deposit Required

25% of total cost at booking. Non-refundable in all cancellation cases.

Balance Due

30 days before departure. Full payment required for last-minute bookings.

03 — Payments & Pricing

Payments & Pricing

All prices are quoted in United States Dollars (USD) unless otherwise stated. We accept the following payment methods:

  • Major credit and debit cards (Visa, Mastercard, American Express)
  • Bank wire transfer
  • Online payment gateways (PayHere, Stripe)
  • Sri Lankan Rupees (LKR) for local bookings at the prevailing exchange rate

Price Changes

We reserve the right to alter prices at any time prior to booking. After booking confirmation, prices are fixed except in cases of:

  • Government-imposed taxes or levies affecting travel costs
  • Significant currency fluctuations (exceeding 10% from the date of quotation)
  • Fuel surcharges from transport providers

In such cases, we will provide 30 days' written notice and you may cancel without penalty if the increase exceeds 8% of the total package price.

04 — Cancellation

Cancellation Policy

If you need to cancel your booking, you must notify us in writing to bookings@ceylonhorizons.lk. Cancellation charges apply from the date we receive written notice:

30 – 60 days 50% of total tour cost
15 – 29 days 75% of total tour cost
7 – 14 days 90% of total tour cost
Less than 7 days / No show 100% of total tour cost

Note: Cancellation charges apply regardless of the reason for cancellation, including medical emergencies or travel disruptions. We strongly recommend purchasing comprehensive travel insurance that covers cancellation costs.

Cancellation by Ceylon Horizons

We reserve the right to cancel any tour due to insufficient bookings, safety concerns, natural disasters, or events beyond our control. In such cases, we will offer a full refund or alternative arrangements. We are not liable for additional costs such as flights or visas you may have purchased independently.

05 — Amendments

Amendments to Bookings

Requests to change tour dates, itinerary elements, or accommodation must be made in writing. Amendment fees apply:

  • Changes requested more than 60 days prior to departure: USD 25 per amendment
  • Changes requested 30–60 days prior: USD 50 per amendment
  • Changes requested less than 30 days prior: treated as a cancellation and re-booking; standard cancellation charges apply

Amendments are subject to availability. We cannot guarantee that all requests will be accommodated.

06 — Travel Insurance

Travel Insurance

We strongly recommend that all travellers purchase comprehensive travel insurance prior to departure covering:

  • Trip cancellation and interruption
  • Medical expenses and emergency evacuation
  • Personal baggage and valuables
  • Personal liability
  • COVID-19 related disruptions

Ceylon Horizons does not provide travel insurance. Travelling without appropriate insurance is entirely at your own risk. We may require proof of insurance for certain high-activity tours.

07 — Our Responsibilities

Our Responsibilities

Ceylon Horizons acts as a tour operator, coordinating services provided by hotels, transport operators, and activity providers ("Suppliers"). We are responsible for:

  • Selecting reputable suppliers and monitoring service quality
  • Providing accurate descriptions of tours and services
  • Communicating itinerary details and updates promptly
  • Assigning an experienced, licensed tour guide where included in the package
  • Providing 24/7 emergency contact support during your tour

We are not responsible for services directly contracted by the traveller, independently booked flights, or services rendered by parties not engaged by us.

08 — Your Obligations

Your Obligations as a Traveller

As a traveller, you agree to:

  • Hold a valid passport with at least 6 months' validity beyond your travel dates
  • Obtain all required visas, including Sri Lanka's Electronic Travel Authorisation (ETA) where applicable
  • Ensure all health requirements (vaccinations, fitness for activities) are met before travel
  • Comply with local laws, customs, and cultural norms of Sri Lanka
  • Behave respectfully towards guides, other travellers, and local communities
  • Disclose any medical conditions relevant to the tour prior to departure
  • Follow safety instructions provided by guides and activity operators

Important: Ceylon Horizons reserves the right to remove any traveller from a tour without refund if their behaviour is deemed dangerous, disruptive, or disrespectful to others or to the local culture and environment.

09 — Force Majeure

Force Majeure

Ceylon Horizons shall not be liable for any failure or delay in performance of its obligations under these Terms arising from circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (floods, earthquakes, tsunamis, volcanic eruptions)
  • War, civil unrest, terrorism, or political instability
  • Pandemics or public health emergencies
  • Government travel bans, border closures, or regulatory restrictions
  • Strikes, industrial action, or airline disruptions
  • Infrastructure failures (power outages, road closures)

In force majeure situations, we will make every reasonable effort to provide alternative arrangements or credit notes for future travel. Refunds in such cases are governed by the policies of the relevant suppliers.

10 — Complaints

Complaints Procedure

We are committed to resolving any issues promptly. If you have a complaint during your tour:

  1. On-tour complaints must be raised immediately with your tour guide or our local operations team so they can be addressed in real time.
  2. If not resolved on-tour, submit a written complaint to feedback@ceylonhorizons.lk within 28 days of your return date.
  3. We will acknowledge your complaint within 5 working days and provide a full written response within 28 days.

Complaints submitted more than 28 days after return may not be considered, as our ability to investigate may be significantly reduced.

11 — Limitation of Liability

Limitation of Liability

To the fullest extent permitted by law:

  • Ceylon Horizons' total liability to you shall not exceed the total price paid for the relevant tour.
  • We are not liable for indirect, consequential, or punitive damages, including loss of enjoyment, business losses, or additional travel costs.
  • We are not liable for the acts or omissions of independent suppliers, including airlines, hotels not contracted by us, or activity operators.
  • We are not liable for loss or damage to personal belongings, injury, illness, or death except where caused by our negligence or breach of duty.

Nothing in these Terms limits liability for death or personal injury caused by our proven negligence, or for fraudulent misrepresentation.

12 — Intellectual Property

Intellectual Property

All content on the Ceylon Horizons website — including photographs, videos, tour descriptions, itineraries, logos, and written content — is owned by Ceylon Horizons or its licensors and is protected by copyright law. You may not reproduce, distribute, or use any content for commercial purposes without prior written consent.

You grant Ceylon Horizons a non-exclusive, royalty-free licence to use any photographs or reviews you submit to us for marketing and promotional purposes.

13 — Governing Law

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

We encourage resolution of disputes through good-faith negotiation before resorting to litigation. Mediation services are available through the Sri Lanka Tourism Development Authority.
